These Terms of Service (“Terms”) govern your access to and use of Kalaman (“Kalaman,” “we,” “us,” or “our”), including our website, services, features, and any content made available through them.

Please also review our Content Guidelines, Privacy Policy, and Cookie Policy, which form part of these Terms.

By accessing or using any part of Kalaman, you agree to be bound by these Terms. If you do not agree, you must not access or use the site.

1. Adults-Only Site

Kalaman is intended solely for responsible adults.

You must be at least 18 years old or the age of legal majority and consent required to access adult material in your jurisdiction, whichever is higher, to access or use Kalaman.

   • sexual exploitation, trafficking, coercion, or abuse;
   • bestiality where prohibited by law;
   • incest where prohibited by law;
   • real-person intimate images shared without consent;
   • any other content prohibited by applicable law.
3. Post personal, confidential, or private information about another person without a lawful basis and, where required, their consent.
4. Threaten, stalk, dox, blackmail, intimidate, or harass other users or third parties.
5. Impersonate any person or entity, or falsely state or imply any affiliation.
6. Use Kalaman to promote commercial products, services, spam, scams, or deceptive schemes without our prior written permission.
7. Use Kalaman to solicit illegal activity or to distribute malware, malicious code, or harmful links.
8. Attempt to bypass age gates, access controls, moderation systems, or account security features.
9. Interfere with, disrupt, attack, reverse engineer, scrape, or abuse any part of the software, systems, or infrastructure used to operate Kalaman.
10. Use bots, scripts, automated tools, or mass-registration methods to access or interact with the service in an unauthorized manner.

4. User Content

You remain responsible for any content you post, upload, submit, or otherwise make available on Kalaman (“User Content”).

By submitting User Content, you represent and warrant that:

1. You own the content or have all rights, licenses, consents, and permissions necessary to submit and authorize its use on Kalaman.
2. Your User Content does not infringe any copyright, trademark, privacy, publicity, database, or other rights of any person or entity.
3. Your User Content complies with these Terms, our Content Guidelines, and applicable law.

You grant Kalaman a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, format, adapt for technical purposes, display, distribute, and make available your User Content for the operation, improvement, moderation, promotion, and provision of the service, subject to our Privacy Policy and any feature-specific settings you choose.

You may remove your User Content where the platform functionality allows it, but you acknowledge that:

• copies may remain in backups for a reasonable period;
• content already shared with other users may remain visible to them;
• we may retain content where required for legal, compliance, fraud-prevention, or safety purposes.

5. Copyright and Intellectual Property

You agree not to post any material for which you do not own or control the necessary rights.

If you submit content that infringes copyright or other intellectual property rights, you may receive a warning, have your content removed, have your account suspended or terminated, and, where appropriate, face legal action.

7. Account Security

If Kalaman offers user accounts, you are responsible for:

• maintaining the confidentiality of your login credentials;
• all activity conducted through your account;
• notifying us promptly of unauthorized access or suspected security incidents.

You may not access another user’s account without authorization.

8. Our Right to Remove Content or Restrict Access

We reserve the right, at any time and in our sole discretion, to remove, restrict, disable access to, edit, review, or refuse any content, account, username, profile, or activity, with or without notice, for any reason or no reason, subject to applicable law.

9. No Guarantee of Availability or Moderation

• training, fine-tuning, evaluating, or operating artificial intelligence systems;
• building or enriching datasets;
• creating embeddings or vector databases;
• generating derivative outputs based on Kalaman content;
• text and data mining except where non-waivable rights under applicable law override contractual restriction.

All content on Kalaman is protected by copyright and other applicable rights and belongs to its respective authors, Kalaman, or both, as applicable.

Any unauthorized use of Kalaman content for AI-related purposes, including use by third parties of outputs derived from models trained on Kalaman content without permission, constitutes a violation of these Terms and may result in legal action.

We may also use technical measures, including robots.txt and other access controls, to restrict crawling, scraping, and automated collection.

13. Username, Profile, and Promotional Restrictions

You agree not to use Kalaman to advertise or promote any external commercial website, product, service, escort service, subscription funnel, or monetized offering without our prior written consent.

You may not use a domain name, URL, or deceptive commercial identifier as your username if we determine it is intended for spam, impersonation, or unauthorized promotion. We may change or remove such usernames without notice.

14. Security and Abuse

You agree that you will not attempt to abuse the software or hardware that runs Kalaman, including by:

• probing or testing vulnerabilities without authorization;
• bypassing access restrictions;
• manipulating rankings, votes, reports, or metrics;
• attacking other accounts or backend systems;
• using the service in a way that degrades performance or harms other users.

Unauthorized attempts to interfere with the service may result in immediate suspension or termination and possible legal action.

Kalaman may contain links to third-party websites or services. We do not control and are not responsible for third-party content, privacy practices, or terms. Accessing third-party services is at your own risk.

16. Disclaimers

To the maximum extent permitted by law, Kalaman disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or suitability of content.

We do not guarantee that content on Kalaman is accurate, complete, lawful in every jurisdiction, or suitable for your preferences.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer protections.

17. Limitation of Liability

To the maximum extent permitted by law, Kalaman and its owners, operators, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, reputation, or business arising out of or related to your use of or inability to use the service.

Where liability cannot be excluded but may be limited, our aggregate liability shall be limited to the greater of:

• the amount you paid us, if any, in the 12 months before the claim arose; or
• EUR 100.

This limitation does not apply to liability for intentional misconduct, gross negligence where non-excludable, death or personal injury caused by negligence where non-excludable, fraud, or any other liability that cannot be excluded or limited under applicable law.

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Kalaman, its owners, operators, affiliates, employees, and service providers from and against claims, liabilities, damages, losses, and expenses arising from:

• your User Content;
• your breach of these Terms;
• your violation of any law or third-party right;
• your misuse of the service.

If you are a consumer in the EU, this clause applies only to the extent permitted under applicable mandatory consumer law.

19. Suspension and Termination

We may suspend, restrict, or terminate your access to Kalaman at any time, with or without notice, for violation of these Terms, legal risk, safety concerns, operational necessity, or other legitimate reasons.

You may stop using the service at any time.

Sections that by their nature should survive termination will survive, including provisions relating to intellectual property, liability, dispute resolution, and enforcement.

20. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Austria, without regard to conflict-of-law rules.

If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms deprives you of those protections.

Any dispute shall be subject to the exclusive jurisdiction of the courts of Austria, except where mandatory consumer law provides otherwise.

21. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the revised Terms and update the “Last Updated” date. Where required by law, we will provide additional notice.

Your continued use of Kalaman after the updated Terms become effective constitutes acceptance of the updated Terms.
